Issuing a legal notice for eviction to the tenant is a statutory requirement before taking legal action or filing a suit for eviction 

It would be better to issue notice to vacate the demised premises, even if the tenancy is created orally or in writing. Subsequently the notice will form part of petition for eviction of tenant.
