Hello,
Please let me know the process of Substitution Application as My Father expired last month and there are two pending Criminal Cases against two person which I want to Contest on behalf of my father. It will be really helpful if you can please guide me with the process. In both the cases, I am the witness in the Charge sheet.

In a case instituted on a police report there is no question of any abatement. Even if de facto complainant dies while case is pending before Magistrate or before Sessions Judge, as the case may be, no question of abatement arises because trial is conducted by the prosecutor. He will take necessary steps to procure the presence of witnesses.
