Sohrabuddin Encounter

Why there are so many hue and cries over encounter of an established criminal, who was a headache for Police of several States?

Is it not wastage of time, energy and resource of public exchequer?

As I know thro’ the media that this case is being investigated by CBI, in response to the PIL filed by his brother who is having backup of “Javed Akhtar”. Perhaps Hon. SC is monitoring the case.

CBI has failed in solving the murder of GM of NHAI Satyendra Dubey.

Also it has forgotten or slowed on the famous “Arushi Murder Case” case of “Anchal Sharma of J&K” and many more.

Around some 8 to 10 yrs back, an incidence reported in a News Paper, that a 10 yr old daughter of a housemaid was raped by a Police personal at east Delhi. The housemaid was working at east Delhi and she was originally from West Bengal. When she reached the Police station for lodging complain, the Policemen threatened her to not to rake up this issue, gave her Rs 10,000/ and ensured her deportation back to West Bengal. What impact would have been on the psyche of that 10 yr old girl about Police and justice system? Media did not give coverage or pursued to this incidence and still the role of media is Limited. Can anyone in this country ensure justice to such unreported/underreported cases? Who will file PIL on behalf of this poor girl? Everyone is busy on highlighting High Profile incidence and incidence Gujarat.

If we forget about the politicians, then also four IPS officers are in jail. Does it not a blow to the Police? If some terrorist activity will happen then will court come to our rescue. Most of the riot cases have been transfered to Maharastra from Gujarat. Is it not amount to contempt of courts of Gujarat? Is it not liek curtailing the power of subordinate courts? Why they tranfered to Congress ruled state, why not to a neutral Place? Best would have been that Hon. SC itself would have trialed the cases. Or they would have set up a special court in US or UK and investigation would have given to scotland yard or NYPD.

We all know what happens in trial, and if there is no material available in the record, how a judge convicts any person.

Either they have no faith on the criminal justice system or they do not consider courts of Gujrat reliable?

Only God can save this country.

Those terrorists exchanged [( Mushtaq Ahmed Zargar, Ahmed Omar Saeed Sheikh (who was later arrested for the murder of Daniel Pearl) and Maulana Masood Azhar (who later founded Jaish-e-Mohammed).] in IC814 hijacking case, were languishing in jail for more than five years. Also two attempts were made to liberate them. In one of the attempts an underground tunnel from the jail was dig to free them, but it failed because Maulana Azhar Masood got stuck in the tunnel due to his overweight. A jail attendant laughed at him and advised to reduce his weight then he replied I am your country’s son in law and your minister will leave me to my house. And it happened.

Once when Indian Media asked from Pakistani General that these most wanted terrorists have taken shelter in your country and roaming freely, then the Pakistani General replied “How can u call them terrorists, they were languishing in your jail for more than five years,  Did any charge sheet get filed against them from ur govt? So, no charges are proved, how u can say them terrorist or criminal?

Had they been killed in encounter then we would not have suffered those losses due to Hijacking? Same thing happened with Dawood Ibrahim, when he was in clutch of Indian Police, had he too been killed in encounter today, we would not have witnessed Mumbai Blast and many more.

It is unfortunate that we don’t have any separate law and investigation agency to deal with such type of professional criminals; they need elimination in budding stage only.

Why we r soft on such type of criminals and wish to keep them in jail at the expense of public exchequer? Situation becomes more pathetic when court comes in support of them.

Where were CBI and other Investigation agency, and why they failed to file even charge sheet in five years when those terrorists were languishing in Indian Jail?

Should not we execute professional/hardcore established criminals like Sohrabuddin, Abu Salem, and Mohd. Dausa etc and others by organizing/holding Camp Courts as early as possible, since they are languishing in jails at the cost of public exchequer.

It seems that our justice system is more concerned or interested to provide justice to the criminals than the common law abiding man.

Even China and Singapore are executing hardcore professional criminals in spite of resistance or opposition from Human Right Groups.

Singapore has laws and penalties that include judicial corporal punishment in the form of caning for offenses such as rape, violence, rioting, drug use, vandalism of property, and some immigration offences.[42][43] Singapore also imposes a mandatory death penalty for first-degree murder and drug-trafficking.[44] Amnesty International has estimated that Singapore has "possibly the highest execution rate in the world relative to its population".[45] The government argues that Singapore has the sovereign right to determine its own judicial system and impose what it sees as an appropriate punishment.

Arupji,

The matter is off course serious nature, where for narrow political gains an established criminal is getting undue importance.

On the other hand the genuine cases are not even failing to get any attention. Wide spread gross injustices are there to look at, which can repose faith in justice system if addressed, this also may help in establishing healthy national feeling.

Arup (UNEMPLOYED)     28 July 2010

I AGREED WITH YOU ON THIS POINT THAT, - POLITICAL PERTIES SHOULD NOT TAKE ADVANTAGE OF SUCH CASES.

BUT IT IS IN VAIN. NOBODY IS THERE TO LISTEN IT AND WE (THE COMMON PEOPLE) ARE IN THE ROLE OF DHRITARASTRA. WE DONOT HAVE ANY POWER TO CONTROL ALL THESE POLITICAL MISCHIVES.

I LIKE TO ATTRACT YOUR KIND ATTENTION THAT - AT THE TIME OF NDA, NOTHING SOLID DONE FOR THE BOFFERS CASE OR QUOTRECHI. AT THE TIME OF UPA NO SOLID STEPS TAKEN AGAINST THE SCAMS OF NDA LEADERS. SEEING ALL THESE I FEEL THAT, THESE POLITICAL PERTIES SHOUTING FOR POLITICAL GAIN ONLY.

LATEST EXAMPLE IS 'PRICE HIKE'. EVERYONE (LEADER OF ALL POLITICAL PARTIES) AGREEVED BUT THEY DO NOTHING EXCEPT SHOUTING.

But Arup sir,

If it is or nay issue raised and get highlighted or widely criticised in literal circle, it may creat an impact. Whether they act or not but we must raise our voices and deep anguish otherwise they will take us for granted.  It si our duty also.

Arup (UNEMPLOYED)     28 July 2010

I THINK CBI'S LATEST STEP IS CORRECT. BUT WHAT THEY DOING IN BOFORSE CASE? WHY THEY SILENT? AS PUBLIC MONEY UTILISED TO MAINTAIN CBI. PEOPLE HAS EVERY RIGHT TO MAKE CBI ACCOUNTABLE. THEIR REAL MASTER NOT THE RULLING PARTY BUT THE PEOPLE OF INDIA.

We r a Nation where an honest and law abiding are most unwanted persons. Since an Honest always stand alone, whereas wrong persons always flock together. With wide spread lawlessness and gross injustice and corruption etc, we can safely draw this conclusion that all Investigation agencies be it CVC, CBI and other govt. agencies are useless, worthless and all less. They failed miserably in their objective and have become burden on public exchequer and a potent tool at the hand of ruling party. A very serious state of affair.

Arup (UNEMPLOYED)     29 July 2010

fully agreed with you.

Judge who ordered CBI probe in Sohrab case, himself probed for corruption

Ahmedabad, 1 August, 2010

Asutosh Asthana, who could be harmful for alleged corrupt judges mysteriously died in custody. Family alleged that he was killed to rescue powerful people

-CBI probe in Sohrabuddin encounter case was ordered by Supreme Court judges Tarun Chatterjee and Aftab Alam in last January. Justice Tarun Chatterjee ordered CBI probe “to check larger conspiracy in the case” on last day of his retirement.

-Justice Tarun Chatterjee is presently tipped for a new assignment — that of the mediator in the border dispute between Assam and Arunachal Pradesh by Congress/UPA govt in centre.

-It should be interesting to note that the SIT probe against Narendra Modi and others was ordered by another Supreme Court judge Arijit Pasayat also on last day of his retirement.

-Pasayat who ordered SIT invesitgation against Modi, Gujarat ministers and Gujarat police officials, was appointed head of the Competition Appellate Tribunal (CAT) in Delhi on sixth day after his retirement by UPA/Congress govt in centre.

More on Tarun Chatterjee and corruption allegation, CBI probe against him

-The Central Bureau of Investigation (CBI) has recently recommended action against a former Supreme Court judge Tarun Chatterjee and 23 other judges for their role in the infamous multi-crore Ghaziabad provident fund (PF) scam.

-A foolproof case could not be built against several judges including Chatterjee because of the mysterious death of the main accused and bill clerk Ashutosh Asthana. Asthana, who died under mysterious circumstances in Dasna jail in Ghaziabad, had named several judges including Tarun Chatterjee as beneficiaries of the money illegally diverted from the state treasury in his confessional statement before a magistrate. Asthana’s family had alleged that Asthana was killed by poison in custody.Family said he was “murdered” on the instructions of powerful people involved in the scam.

-Following is India Today report on Chatterjee’s involvement in corruption case:

The CBI, sources said, had questioned Justice Chatterjee at his residence towards the end of 2008 while he was a Supreme Court judge, after seeking permission from the then CJI K. G. Balakrishnan.

Sources said a CBI team went to Chatterjee’s official residence and questioned him on Asthana’s statement before a judicial magistrate.

Asthana had alleged that household goods were purchased and transported from Ghaziabad to his house in Kolkata.

The CBI had also questioned Justice Chatterjee’s son Anirudh Chatterjee in Kolkata on allegations that he had accepted a laptop and a mobile phone.

Though Justice Chatterjee denied the allegations during questioning, the agency, sources said, was able to match the handwriting on the bills to a relative of the former apex court judge.

The ex-SC judge had, however, claimed that he had foot the bill himself and had exhibited photocopies of a cheque he had given to the shopkeeper as proof, sources said.

-You can GOOGLE relevant keywords to know more on this. Dozens of news reports have been published on these affairs.
