She not appeared for any hearing during maintenance appeal

Dear Sir/Madam,

I appealed against maintenance amount ordered during DVC. It is now 10 months and she did not appeare for single hearing. Judge is giving dates every month and no action taken yet.

My question is what are my options available in this case?

  1. File an Application to close and proceed appeal case ex-parte. - OPTION
  2. I hope stay of trial Court proceedings were granted in your Appeal case?  
  3. I also hope Service Notice was effective and Server Affidavit is in File?
