Seeking help on false police complaint and fir filed by friend

Hi all, I need advice on a dispute that turned into a police complaint. About 2–3 years ago, my friend and I had normal arguments on WhatsApp/Telegram, just typical insults like calling each other fake, nothing serious or threatening. Recently, I found out more about his fakery and sent him a moderately insulting message, no threats, nothing serious. After that, I blocked him. Then he started OTP bombing and call/SMS spamming me, so I unblocked him to call him out over Whatsapp, then blocked him again. He tried to contact and argue but I ignored all messages/calls. Frustrated, he filed a complaint against me in Bangalore under harassment, verbal abuse, and defamation. Before also I'd seen him threaten to file fake police complaints against others when upset. He sarcastically sent me the complaint number and said he plans to go to the police station tomorrow to talk to them. I live in Pune, and I want to know: 1) How will FIR and investigation work across state lines? 2) Can police refuse to register FIR in such minor disputes? 3) Should I get a lawyer now? 4) How strong is a complaint based on a single moderate insulting message after years, especially when he also harassed me with OTP bombing? 5) Will this affect my career if the FIR closes without charges? 6) Affordable legal help options in Pune? 7) Do I need to travel to Bangalore because of this? Thanks in advance!

nothing to worry now, just filing complaint does not prove it, until police don' investigate you just don need to do anything. If they call you tell them it is all false and you are not staying in Bangaluru.

Just instead file a complaint in police for harrasment and counter the complaint in PUNE .

He will just come to knees.

Given the facts, your priority ought to be deescalating the issue. There is no need to react. Action could be thought of if the police accept the complaint and register FIR.

 1) FIR and Investigation Across State Lines Jurisdiction matters: FIRs are typically filed where the alleged offense occurred. If your friend filed in Bangalore, the police there will initiate the process.

Cross-state cooperation: If the FIR leads to investigation, Bangalore police may request Pune police to assist (e.g., for questioning or serving notices).

Zero FIR: If the offense occurred in Pune but was reported in Bangalore, it may be treated as a “Zero FIR” and transferred to the correct jurisdiction.

 2) Can Police Refuse to Register FIR in Minor Disputes? Yes, if non-cognizable: Minor verbal insults or personal disputes often fall under non-cognizable offenses (e.g., defamation, verbal abuse), where police can refuse to register an FIR directly

3. Magistrate route: In such cases, the complainant must approach a magistrate, who may direct police to investigate under Section 155 or 156(3) of CrPC.

 3) Should You Get a Lawyer Now? Highly recommended: Even if no FIR is registered yet, a lawyer can: Draft a response or anticipatory bail application (if needed) Help file a counter-complaint for harassment (OTP bombing, spamming) Monitor the complaint’s progress and advise on next steps6

 4) Strength of the Complaint Weak case: A single moderately insulting message after years of mutual arguments is unlikely to hold up as criminal harassment or defamation. Mutual provocation: His OTP bombing and spamming can be used to show retaliatory behavior and lack of genuine victimhood. Digital trail: Preserve all messages, call logs, and screenshots. They’re crucial for your defense.

 5) Career Impact if FIR Closes Without Charges Minimal impact: If no charges are filed or the FIR is quashed, it generally won’t affect your career8. Background checks: Some MNCs or government jobs may ask about pending cases, but a closed FIR without conviction is not a disqualification. Precaution: If an FIR is filed, consider filing for quashing under Section 482 CrPC to clear your record.

It is just a threat. If at all there is any complaint made to the police, the police will firstly inquire about it and investigate the matter to find out if it is cognizable or non cognizable.

The contents clearly shows that there is no complaint or case made out, hence you remain silent and as usual block him everywhere and do not ever be in touch with him for any reason.

If at all it is developed into  a criminal complaint and if yo are summoned by police then you can take the help of a lawyer to solve it

Did you received any notice / summon / call from police ? No.

Do not react and let the things die its own death, untill there is something especifically and officially intimation.
