Section 409 and 420 on purchase of govt floor from agent



A friend of mine has been charged with Section 409 and 420 about 4 years ago. He owns a flour mill (private business) and had bought wheat from a Govt Agent (who owned a Dipu). Police raided his shop and caught the driver of the van and him ( based on the information received from an informant). I have 2 questions on this.

1. Is 409 applicable on private shop owners?

2. All the witnesses were very weak and the lawyer assured that case will in our favour. Can the forum enlighten me what are the possible outcomes of this case?

3. In case, the local court gives punishment when can we apply for bail?
