Offence u/s 346 IPC

Whoever wrongfully confines any person in such manner as to indicate an intention that the confinement of such person may not be known to any person interested in the person so confined, or to any public servant, or that the place of such confinement may not be known to or discovered by any such person or public servant as hereinbefore mentioned, shall be punished with imprisonment of either descripttion for a term which may extend to two years in addition to any other punishment to which he may be liable for such wrongful confinement.

Answer: It would be find out in investigation by police whether an adult (22 years old) kept himself/herself out from home with his/her free consent or some person has committed above said offence.

Dear querist,

1.      The reason why police will be on the lookout for you is your parents, family, and a friend are unknown about where and what about, and they do not a clear idea as what might have happened to you, that is the reason why they might’ve filed a complaint in the police station of their locality to know about your condition and whereabouts.

2.      Secondly, it is advisable to let the police know about your whereabouts because this will give enough assurance to your family that you are in a safe condition also if you want to keep your information confidential as an adult you can do so by disclosing material facts of your situation by reasonable excuses and reasoning behind your statement for the officers to keep your location confidential from your parents or family.

3.      Also, the passage of carious order from the High courts of Karnataka and Madras, has led to the implementation of strict procedures for the police officers to file and investigate the complaints of missing persons, and simultaneously if they fail to carry out the investigation, as a result, strict disciplinary actions might be taken against them.

4.      Furthermore, to take a step beyond this the police officers register the information of the missing person in the Crime record bureau, which is NCRB, and under that particular department, the officials maintain a database called “TALASH” which maintains the records as well as acts as an information cum documentation portals for missing person.

5.      Thus, because of the above-stated reasons the police carry out an investigation thoroughly to find the missing person regardless of their age.

Hope this answers your concerned questions.

It is simple, if the parents and/or relatives file a mssing person FIR the police are duty bound to search and find him/her.
