Rti section 6(3) query

Dear Experts,

I am confused with the RTI Section 6(3) rule. I sent one RTI application for seeking some information to PIO , O/o Municipal Commissioner,  on 1st September 2025 . I have not recieved any reply from the PIO even after 30 days, so after 40 days (i.e) on 10th October 2025 I sent First Appeal to the First Appellate Authority, O/o The Municipal Commissioner and now after 50 days (i.e) on 20th october 2025, The PIO, O/o Municipal Commissioner forwarded to his sub ordinate officer (i.e) PIO, O/o The Superintending Engineer and now even after 30 days till today also the deemed PIO,  O/o The Superintending Engineer did not reply.

As per my knowledge, I noticed these voilations :

 1) The PIO, O/o The Municipal Commissioner did not transfer my RTI application to the deemed PIO, O/o The Superintending Engineer within 5 days by voilating  RTI section 6(3) but transfered my application to the deemed PIO after 50 days (i.e) after filing my First Appeal to the same Municipal Commissioner office.

 2) The Deemed PIO, O/o The Superintending Engineer did not reply or provided any information even after 30 days till today by voilating RTI section 6(1).

 My Query is as follows :

  Now i wan't to file complaint to Information Commissioner, So against whom I should give complaint either PIO, Municipal Commissioner or Deemed PIO, O/o Superintending Engineer ? Since both have voilated RTI Act, The PIO, Municipal Commissioner dId not transfer my RTI application in time (i.e) within 5 days but after 40 days after filing my First Appeal transferred to deemed PIO and the deemed PIO, O/o Superintending Engineer did not provided information even after 30 days till today .

It would be against FAA if you are not satisfied with the order / action taken.

Should I again file first Appeal to the First Appellate Authority O/o The Superintending Engineer since the first PIO, O/o The Municipal Commissioner transferred my RTI application to the deemed PIO , O/o The Superintending Engineer but the deemed PIO, O/o The Superintending Engineer did not provide information even after 30 days ?

The first appellate authority is typically a senior officer within the same municipality, such as the  Deputy Director or Additional Commissioner; the specific designation varies from a state and municipality.

Since PIO (you may find designation) did not reply your application u/s 6 of the RTI Act, 2005 you are required to file an appeal u/s 19 of The RTI Act, 2005 before First Appellate Authority (which is not by designation / office but as FAA).

If the Public Information Officer (PIO) does not respond, you should file a first appeal. If the First Appellate Authority (FAA) also does not respond within 45 days of filing the first appeal, you can file a second appeal with the State Information Commission (for a state public authority) or the Central Information Commission (for a central public authority).

The second appeal must be filed within 90 days of the date the first appeal decision was due (45 days after filing the first appeal)

You should file a complaint against both officers

  1. PIO, O/o Municipal Commissioner – for violating Section 6(3) by failing to transfer your RTI within 5 days.

  2. Deemed PIO, O/o Superintending Engineer – for violating Section 7(1) by not providing information within 30 days after receiving the RTI.

Mention both violations clearly in your complaint to the State Information Commission.

It appears you have in any case did notreceive informationfrom any or PIO or deemed PIO, within 30 days.

 

It also appears that FAA has notresponded.  Nothing stops you from making compliant to Commission against both of the PIO as cause of action is single application you can join both.
