I purchased 2 flats on ground floor (Ground+2 apartment Building)in 2008. The owner I purchased was a First purchaser from the builder/owner of the plot/building. (FYI, after construction of the building-the owner of the plot/building kept or was staying himself in two adjacent flats on ground floor and sold the upper floors(4 flats). At the time of construction he constructed a small room at one of the corner for temporary stay for labors which remained till the owner sold both the ground floor to 1 person. The first purchaser of the flats started using the same room as it was on ground floor and claimed he should have the right to use it as he purchased both the flats on ground floor from the Land owner/Builder).
For this the 4 occupants objected and filed a case in municipality seeking the demolition of the room claiming he has done illegal construction. The case was running until (Mar-Apr)2012 in the tribunal court.
I purchased both flats in 2009 and was not aware that there is a case pending on the owner. When I left for overseas(after my vacation) the same 4 occupants filed a case on me in 2010(while their fist complain/case was still going on in Tribunal Court) calming I have done an illegal construction.
(Note: the dates/period they mentioned - I was working in overseas during same period) My wife delivered baby in Feb-2010 and was not able attend the hearing of the case. Hence I requested a vacation in Nov-Dec-11 to attend the same. But unfortunately due to International Film Festival during the same period, the tribunal court postponed the hearing for another date in Jan-2012.I returned to work as it was not possible for me to extend my leave.
My question is- can anyone file a case on two individual at two different time on same matter?
Also, I want to file a case under "damage to reputation" or defamation and for compensation on the four occupants as they falsely put a case on me when I did not carried any construction. The main important part is I have proof that I was in overseas during the same period. Is it possible? If so when I can file a case? As the latest result of the previous case on previous owner went in favor of the person that I purchased the flats. Indirectly it is in my favor. Now the new case which they filed against me is still going on in municipality. Please advise me how I can file a case on them for false complaint ? Hope I'll get a right advice
