Rera execution petition

I had filed a complaint with Karnataka Rera Court in 2021 claiming interest for the delayed period of project completion. K Rera dismissed the case and I went for appeal to K REAT. The Order was in my favour, but the builder filed a review petition, which was dismissed. Again the builder went to file an appeal in Karnataka High court. As per High court web site, I find the following daily order “ Issue I.A. 2 /2026 Steps shall be taken in one week failing which the appeal shall stand dismissed, without further reference to this court. Last updated on 2026-04-30” After this publication in the High court Website, there were no update on “daily Order”. I was also checking the cause list in the High court website. I could not find the case listed for hearing. Until the end of this June 26. My question iis :: As this case appears to be dismissed as the builder has not complied with depositing of interest amount as per sec 43(5), Can I go back to K REAT file an execution petition claiming interest as per K reat order ? Or is there any procedure to be followed before filing an execution petition?

RERA order is enforceable. If the builder does not comply within the time the order gives, file an execution or non-compliance application with the same state RERA authority that passed the order. Ask the authority to issue a recovery certificate to the District Collector so the dues can be recovered as arrears of land revenue, which allows attachment and auction of the builder's property. Track the certificate at the Collector's office, use RTI to find where the file is stuck, and take legal advice if the builder enters insolvency.

In the absence of any stay order by high court you may better file an execution petition to execute the REAT order before the executable court
