Renting apartment without agreement

Hi

I am renting an apartment in Hyderabad since 3 years. For the first year we made an agreement which expired 2 years ago. The tenant is a good guy who always pays rent in time and is decent in behavior. I have no problems with him or his family so I am letting him continue without an agreement. 

I am an NRI living outside India. I heard that the new rent act 2025 requires that rental agreements must be digitally registered every year. My question is -- are we allowed to rent the apartment without an agreement at all, just based on mutual understanding? Or does the act require us to have an agreement whenever we rent a unit? It is hard, almost impossible for me to come down to India just for the purpose of signing the agreement and find witnesses also who are willnig to sign, which is why my query.

It is always safe, legal and advised to execute a rent agreement.

If the property is rented out for one year and above, it has to be compulsorily  registered.

Without registration of the rental agreement you cannot handle the litigation that may arise at a later date.

If you are unable to visit India you can execute a power of attorney deed in favour of any close relative to handle such situations on your behalf.

Therefore it is advisable to abide by latest rent control law for your own benefit.

Rental agreement and police verification of tenant is must .you can get executed rental agreement through power of attorney holder.

You shall give a POA to your relatives/close friends to execute the rent(lease for rent)agreement, and get it registered to avoid all legal issues.
