Related to POCSO Act

Ten years ago an incident happen,assume both victim and culprit are below 18 . culprit forcefully kiss the victim for 30 min approximate. After this incident victim felt traumatised for 2-3 months .After this due to her affection for victim and inorder to protect the victim ,she kept it secret . Also victim forgives culprit and continued their relationship .

In above situation is the act still a offence or punishable under POCSO Act?

The rules are that these convictions will appear on your disclosure for: 15 years, if you were 18 or over at the date of conviction. 7 years and 6 months, if you were under 18 at the date of conviction.

In India, anyone in the age group of 16 to 18 years who has been charged with heinous crimes like rape, s*xual offence or murder can be tried as an adult under POCSO or the Indian Penal Code. This decision usually lies with a juvenile justice board.

Yes, the offence does come under POSCO.
