Regarding filing fir

Hi- We have one of our grand fathers property which is residential building in Bangalore. My mother is elder daughter along with 3 sisters and younger brother. Now we found that my mothers brother has got the property registered u see his name showing legal heir certificate that he is the only one legal heir. Can we file FIR in police station regarding this and get criminal case filed against him?

Instead of filing FIR in PS file partition suit in court. against your mother brother.

As rightly suggested by Expert learned Mr. nanda, you may better file a suit for partition seeking your mother's share in the property, even though it may take a little time, that is the only remedy available before you.

The criminal complaint is only for punishing him but you may have to again file partition suit to claim your rightful share in the property with separate possession.
