Re: appointment of body guard with licensed revolver gun on pay roll in company for director

Namasakar sir's,

In our Real estate company in Mumbai Thane area one Director wants to appoint 3 body guard in company for himself on payroll of the company. Kindly advise whether company can take such bodyguard with licensed weapon in company on payroll of the company. The 3 bodygaurds have licensed revolver gun (with them of their own with all registration of the gun).

Kindly advise whether should we provide them with appointment letter with designation as Bodygaurd as we issue to all employees/staff working in payroll of the company?

Our director advised HR to keep these bodyguards on the payroll of the company, whether a company can keep such bodyguards in payroll of the company? Or should we issue them Fix term appointment letter?

Kindly advise.

Hiring a bodyguard with a firearm is not illegal per se.However, it is governed mainly by Arms Act, 1959 and Private Security Agencies (Regulation) Act, 2005 (PSARA)

Armed guards/bodyguards are generally required to be deployed through a licensed security agency (PSARA license) .

Only such licensed agencies can legallyprovide armed personnel.

From your above answer does that mean that a company cant appoint them on pay roll as 'security personnel (armed with gun)'  just like we issue appointment letter to all employees/staff working in payroll of the company? 

Our director advised HR to keep these bodyguards on the payroll of the company, whether a company can keep such bodyguards in payroll of the company? Or should we issue them Fix term appointment letter?

​Liability: If the bodyguard uses the weapon while on the company’s payroll, the company (and its directors) could be held vicariously liable for any criminal or civil consequences.

Yes, the company can employ private body guards as per rules applicable.
