Query regarding 406

Hi,

I am victim of false 498A,406 and DP act 4&6. I understand 406 is filed for recovery of dowry articles. But the fact is that there is no element of dowry involved other than few gifts given to me.The fact is that  they hold good amount of gold with them given by us at the time of marriage. But in front of police they mentioned that they have given huge gold etc etc and it is mentioned in the chargesheet aswell. There has been no investigation from police about the genuineness of their claim. Obviously there has been no demand from my wife side to police to recover the said articles as the truth with come out.

Please advise if there is a way(through police or court) that can make them return our gold? Please help

THE DOWRY PROHIBITION (MAINTENANCE OF LISTS OF PRESENTS TO THE BRIDE AND BRIDEGROOM) RULES, 1985

(2) The list of present which are given at the time of the marriage to the bridegroom shall be maintained by the bridegroom.

 

so whatever present was given to you at the time of marriage is yours.

 

Please apply for Speedy Trial with the certified chargesheet and FIR. Then the HC will direct the JM to dispose of the matter within 6 months.
