For a case to be dealt under sec.141 of NI Act, 1881, I was able to secure only the signatory accused. Though court issued NBW to other directors, Police delaying in execution of that NBWs. Now I want the Hon'ble HC to direct the Hon'ble MMC to initiate trial against the signatory accused.
My query is; If I file an Writ of Mandamus with Hon'ble HC, I am the Petitioner. I would like to know that whom should I represent as the respondent. I would also be thankful if citation case is provided.
On the other hand, the signatory accused are in bailable warrant for more than 1-&-half years. To recall that bail warrant for trial proceedings, should I file the affidivate for recall request ? (or) should I file a contentation of delay against the accused for non-appearance to court?
