Query

Hi all ... I have a question which is related to my society ... The committee of my society dominates everybody and misuses the power every now and then.

The AGM was conducted and the notice was given before 14 days . However the Balance Sheet , P&L and auditors report was distributed at the time of AGM to all the members . Is this valid as per the MCS act ?? I had so many questions but since i got the balance sheet on the same day I could not go through it in detail . What action can be taken against the committee . Can the AGM be declared invalid .??

Also can the managing committee change their roles internally without taking consent of other members of the society ??

 

Pls guide me on the same .

yes, you may challenge the validity of the AGM in writing to the society and a copy marked to the registrar of the society.

 

The society needs to give the balance sheet, P&L copy and auditors report well in advance alongwith the circular ofthe meeting.
