Property query

Hi Sir, my mother has received property from her mother as per a legal will. Now, if she wants to give it to a third person other than family members, is that possible? Can’t even I question it?

The property acquired by your mother from whatever source becomes her own and absolute property.

She has full rights to dispose off the same in any manner and to any person of her choice.

Nobody can claim any share in that property as a right at least not during her lifetime.

Advocate Vikas Tiwari (ADVOCATE)     03 February 2026

Once your mother inherited the property through a will, it became her absolute self-acquired property. This means she holds full ownership rights and is not legally obligated to keep the property within the family. She has the right to sell, gift, or bequeath it to any third party she chooses.

As her child, you do not have a vested legal claim or 'birthright' to property she inherited via a will. Therefore, you generally cannot legally challenge her decision or 'question' it in court, provided she is of sound mind and making the decision of her own free will. Unless there is evidence of coercion or mental incapacity.

Advocate Bhartesh goyal (advocate)     03 February 2026

The property acquired by your mother through will be deemed her absolute self acquired property and being absolute owner of property she has every right to transfer the property through sell, gift or bequeath to anyone

You and your family members have no right, claim or share in property and also can't question .

Yes.  Iagree with the views of the above experts and nothing more to add.
