Property law

hi sir my grand father have 10 acres land and he have 5 children's (four daughters and one son).in the year 1997 he got expired without doing any will .Now son has transferred all properties on his name without informing to any one .I am one of the daughters son .in the year 2018 my mom also got expired and my father also got expired when I was a 3 year old.now I am asking my mother's brother about property he is saying that if your mother alive I will give the property now I will not give any property go anywhere do whatever you want.

so please guide me sir can I go to court against him to get my mother property share sir

Quick Summary
If your grandfather passed away without a will, his land would typically be divided equally among his children. Your uncle has unlawfully transferred the entire property to himself. As your mother's son, you are entitled to her share. You should consult a local solicitor to file a partition suit in the District Civil Court to claim your rightful inheritance.

You have succeeded the share of your mother, file a suit for partition and possession in the District Civil Court where property is situated i.e., your maternal district, through a local prudent lawyer

Contact a local advocate stating such date of registration of the property, your mother's death, and the stand of your other three aunts.

Yes, file a suit for partition.
