another one filed 50 promissory note suits.

Understand the limitations in guidance online portal members, when the issue is complicated.   It is always proper to take the guidance of an Advocate, who has to take up the cases and defend. based on facts and law.  You can not get precise guidance by seeking guidance in one sentence query when you have to defend several parties in 50+ suits.

Each case needs to defended on its merits. All that couls be suggested is that  Cases under Sction 138 NI Act is a criminal case and it is for the complainant to establish that there had been a legally enforceable debt.
