Promissory note

Sir/s,

Tenant is due for paying rent for over few years. Now, he wants to give promissory note. Amount is about Rs 3 lakhs. Need advice how to go about.

You can obtain promissory note but it will be difficult to prove legally liable debt in the event of future litigation.

Arrears of rent is leviable even in the absence of promisry note.

You can consider to enter into an agreement iwith the tenant instead of the proposed promissory note. While the main agreement is key, the promissory note itself should be on appropriate stamp paper as per Indian law for enforceability. If they refuse a fair agreement, you can send a legal notice for eviction and rent recovery, potentially filing a suit in civil court.

Why do you want / need to continue such tenant ?

File a suit for recovery of outstanding rent as per law, if any.
