Dear Experts,
Purchased the allotment of a plot of 300 sq. yards from a renowned developer and transfer was duly made in my name. The Basic Sale Price was Rs. 6400 per sq. yard. at the time of allotment, which was supposed to be paid in installments as per the development in progress by development.
So far I have not signed any agreement with the developer, but I have letter of transfer in my name.
Now at the time of possession the size of plot has been increased to 407 sq yards and the developer is asking to pay on the increased area as follows :current company price i.e. Rs. 15500 per sq. yard for 77 sq. yards (in addition of 10% of original plot size, i.e. 30 sq. yards).
1. 30 sq. yards (10% of alloted area 300 sq. yards) @ 6400/-
2. 77 sq. yards @ developer's current price Rs. 15500/-
The developer is seperatly charging Rs. 1950/- per sq. yard towards External/Internal Development Charges, which has already been paid.
Developer has never mentioned the percentage of increase/decrease of the area of plot on actual possession. Prominent authorities like HUDA (Haryaha) & Greater NOIDA Authority have earmarked the increase/decrease shall be maximum 20% and that will be charged/adjusted on allotment price.
Before I move to Consumer protection court for redressal of my problem, I want to seek your expert advice.
