 1. Can you please share any of the judgement copy in which right of residence / ownership was provided to mother-in-law in husband's ancestral property ???  Legally she cant stay .
 2. These days even a roadside vendor or a street kid can propose to file 498a / DV if there is any family dispute . Ramani , As you mentioned that there is no way to get other side of the story then on what basis can you imagine the other person's fault .  You  suggesting  " Once he and his sisters are kept in the Police Station for one night they would know what it would be like "  simply reflects your thinking . Sorry mate but LAW IS FOR PROTECTION & NOT FOR HARASSING PEOPLE .
 3. Pardeep , what's making you think that filing cases will provide solution to this lady's problems ??
 4. None of you is talking to actually help the poor lady . Atleast one of you could have volunteered to fight the case FREE OF COST for this lady or could have extended any monetary support . Pardeep , I don't know where this lady is from but i can offer her or her husband a job if in Delhi. Let me know if she is interested ??

Please dont see the poor lady's mother as the Godmother of the house bcoz :
1. She is staying in someone else's home and saving all the money which she could had to spent on the rent . If she is spending money for the house it is much lesser than the amount she might have spent in the rent . Smart arse isn't it ?? You mentioned that she cant afford a house if they move outside .... and she is giving monetary support in the house ..It is clearly evident that she is spending less than what she is saving.  SEEKING MONETARY BENIFITS OUT OF DAUGHTER"S MARRIAGE : THIS IS WRONG .
2. It is husband's ancestral property , ofcourse wife has right of residence .... But This does not give any bl**dy right to her mother to stay in the house . You still have not shared any judgement in which right to residence / ownership was granted to Mother-in -law of husband .. She should vacate without even bothering about the monetary support so that both husband and wife can be independent and think constructivly further in life . Let them be in a situation so that both husband and wife can work and earn . Kodhi mat banao unhe !!
3.    Certainly this poor lady is in no mood to work and earn ... There are many people who relocate more than 20,000 Kms to work , earn and rise in life !! My company have got 4 branches , I can offer her a clener's job in the nearest branch if she is willing.  Can you please disclose the location ? Even small town people have got 02 hands and 02 legs and a brain to work .

Go and file a case if that's the treatment for your stomach ache !! Please engage ramani to fight her case , he knows everything !!
5. What's your status anyways , How are you related to her ??  Are you supporting her by any means especially when you are aware of her condition

1.    As earlier I have mentioned, the lady invited her mother to stay with her, only to protect herself from physical abuse from her husband. Her mother very well can stay with her son at a different place without paying any rent. So, seeking any monetary benefit from daughter’s marriage is ruled out.

2.    Earlier both husband & wife were independent only. Mother has entered into the seen much later when husband started to quarrelling too much and also with physical abuse.

3.    As earlier I informed she is educated and willing to work and for that purpose only she is taking computer training. Thanks for your offer of cleaner’s job for her but it will necessitate her to go out from the house which her husband & sisters-in-laws are looking for to deprive her of that house. Her husband was earlier self employed but ran in to losses and closed the business.

4.    You are absolutely right here to say “LAW IS FOR PROTECTION OF PEOPLE AND NOT TO HARASS THEM”. But so far you want it to be applicable for people against her only and not for her or her supporters as if you are fighting for her husband. But one thing I appreciate that your views was cetainly helpful in understand other side of the coin. So far she has not thought of filing any DV case, expecting that relations will one day become normal.

5.    I have never seen them, only heard about them in detail and wish all well for the family.

Cut the crap out buddy : Basically she does not want to work and want to grab the house and finding ways to kick out husband ....Crying loud " cruelity crueality " will do no good and law has no procoz she is cruel to herselfvision to provide any solution to poverty ..i assure that she will earn enough to afford rentals and daily household expenses if she picks the offer .... if still not interested then even god cannot help this cruel lady .... I termed her cruel bcoz she does not want to think out of box and is cruel towards herself !!

Sam is a member or fit to be amember of SIFF. It is because of people like him Government is thinking of bringing a law that will give right to wife over half the property of her husband. At least this is a typical case where such right should be given.

There are people here who will respond only to posts concerning male-female relationships. They ignore other posts.  The males among them will always attack the wife, irrespective of whether the post is given by the husband or the wife. The opposite will be the case when their female counterparts respond. Probably they all form views based on their respective experiences and hate the world.

Look for previous judgements?  One should look at the circumstances under which the person is and use plain common sense.

The question of right of residence of the mother-in-law will come only if the owner or a legal tenant of the house disputes it. Than kind of dispute has not been reported here.

If thats not in question then why are u supporting it ???? Before suggesting 498a /dv on what basis have you come to this conclusion that it is a fit case ???? Everyone knows the fact behind these cases and thats why more than 98%cases fall flat during trial . Why do you have problem with SIFF?? the law which u are talking about is still in dispute ...please do not quote it till it gets implemented ..... It is not at all relevent here ..

Mr. Sam, why you should use such words against any member? You can put forth your views in a decent manner at the same time respect other’s views in this forum. I’m feeling sorry for starting this discussion turning into an ugly one. Even though I didn’t like some of your comments, I never showed any disrespect to you. I admire if you comment based on available information.

How she is greedy when she is at the fag end of her inning in this world and spending whole of her income from pension on this family. She can very well stay with her son who is well settled and welcoming the mother at any time?

As an original poster of the discussion I never said it, in fact it is contrary to it (as mentioned at many places). It appears that you preconceive some ideas which are not based on facts.

She is educated (a graduate), also doing computer training. You offered a cleaner’s job for her at Delhi or other city branch.  Can you explain why she should move to another unknown city to accept your great offer and how she will manage staying in city alone with a 7 year child for rental (even a single bed room flat), education for child and other needs including security? Why you are so keen about going out of the house and live separately?

1. I just don't understand why are you so keen to let MIL stay in husband's house . If the husbands getting threats of legal cases then it is very much understandable why he is not opposing her stay in his house ... But Boss , weather you accept it or not but MIL sitting on the head at all times always creates friction between the couple .

I dont understand this mentality of people who act snobbish once they complete just a Graduation . I sincerly have now got doubts on her capabilities now ... If she has got GREAT QUALIFICATIONS then what's stopping her from getting the right job ??

3. Her moving out of the house will save her from so called " CREUALITY " ...... She is ready to die and not vacate 4 bedroom house ....Why ?? :-) Funny thinking .

4. Alright if she feel offended by a cleaner's job,  I will give her the designation of Housekeeping Manager and her starting salary will be around 10K . What do you think now ??   For your information there are many Graduates / Postgraduates working in Mc donalds , KFC's have to do cleaning as a part of their job . No job in this world is disrespectful and a person can rise in any damn job provided his/her attitude is positive .

5. What type of security are you talking about .. There are many Insurence companies round the corner which provide these type of services which can be availed at any time !!

6. Every sucessful person has to start with something small ... The start is important and one should not have negative thoughts ..  Spoiling life for a four bedda house does not make sense !!

7. Every city has got education facilities and delhi has got best facilities across the country ...Education for the child is not an issue but its an excuse !~~

 I have a wife and a son. And unlike you there is no 498A against me. Does my talking of common sense hurt you? It must be. People like you, who have suffered at the hands of women justly or unjustly, are afraid of the whole womankind and of course of common sense.

Are you a lawyer by any chance? You are in Delhi. In front of the Esplanade court in Mumbai there are touts to catch clients to brief-less lawyers. There may be some such court in Delhi too?

There are lawyers with no knowledge either of law or anything else. They try to win cases for the accused by insulting and humiliating the opposite side in the witness box, especially if it is a woman. Are you one like that? I think so. You say that you are not a 498A victim. Then are you dowry prohibition act or DVA victim. I had to teach you what IPC – 498A says. What kind of a lawyer are you?  Are you not ashamed?

My son will never be a victim of any of the Protection of women acts. Even if at all it happens,  not even God can save him if you were appointed as his lawyer.

I do not know Hindi. Please do not use Hindi words.
