Payment of gratuity

Dear Sir,

I am a govt. servant needs clarification as under:

Whether payment of gratuity act is applicable to central govt. employees.

If so,why gratuity is denied for a govt servant taking voluntray retirement  service due to many reasons like bad state of health,family problem etc.. Voluntary Retirement is treated as not in public interest and hence,the govt servant is denied to get gratuity as per dopt order of central govt.

Can you please guide in this regards. I have served 20 years in govt. job but wanted to give resignation for my bad health but my office intimate not to pay gratuity on my resignation.

Payment of Gratuity Act, 1972 provides for a scheme for the payment of gratuity to employees engaged in factories, mines, oilfields, plantations, ports, railway companies, shops or other establishments. But not to govt. employees.

Hi

 

All employees are entitle to payment of gratuity, where as continous service of five years will be eligible for payment of gratuity, any violation on this will be an offence.

Payment of Gratuity Act 1972 is apparently not applicable in your case.

 

You may attach the said order and Gratuity Rules of your establishment.
