Partition deed

Hello!

Request guidance.

What will be the charges for registering a partition deed in Maharashtra?

Registration fees? Stamp duty? Advocate fees?

It is 5000 sqft residential zone land in Pune belonging to two brothers equally.

Thanks in advance!

Quick Summary
This discussion seeks guidance on the charges associated with registering a partition deed in Maharashtra, specifically for a 5000 sqft residential land in Pune owned by two brothers. The response clarifies that stamp duty and registration fees are based on the market value of the partitioned property, as per the Maharashtra Stamp Act 1958. While the exact rates can vary, it's mentioned that 2% stamp duty is payable on the value of the partition in Maharashtra, with the major share potentially being exempted.

The stamp duty and registration fee shall be payable on Market Value (government value) and hence you consult in local Sub-registrar office for the value of the property.  The stamp duty and registration fee vary from one State to another State. For the Partition deed, 2% stamp duty shall be payable on the value of the partition (the major share is exempted) in Maharashtra.
