Options available with widow female..

Hi Experts...

One lady's husband passed away with suiside in jan'13. She had two kids one male of 3 yrs another female 5 yrs. Her husband was alone son in his family left with mother father well sourceful( good aggriculture land , big house , fixed income etc). The parents of her husband had thrown her out with two kids. She is living now with her parents and someway managing to feed her kids apart from her alone life without any source of income. She want to teach lesson to her in laws. She want to fight for herself and for her small kids. What rights she have in her hand?. Pl suggest civil and criminall way outs in detail which she can make altogether to fight with full of force for her rights.( Like 125 CrPC, Civil case for partition, 498a, DV Act, etc)

Dear Anu,

It is absolutely clear that the Husband's family is definately liable to maintain the Lady and her children and throwing her out with kids amounts to Domestic Voilence.  The family after death of breadwinner has every right to seek their share in the property by seeking declaration to this effect (even seeking injunction) by filing civil suit,  maintenance could be claimed by Section 125 Cr.P.C. Hope this clarifies.
