I stay in Kalyan in Maharashtra. I am hereby selling my flat in Kalyan. Now very recently society is formed and builder has formed society and share certificate is not issued. Now under the rules of Maharashtra govt my questions are:-
1. Is NOC from society is compulsory for selling of flat to an individual?
2. If share certificate is not issued than what to do ?
When a society is not in existence legally, there is no need for such NOC, etc., from nonexistent society. This fact can be mentioned in the sale deed.
