Need suggestions please help

In lower court 

1. My husband"s divorce case got dismissed by family court judge.

2. I won the Section 9 case in same family court

3. Family court dismissed my maintanence.

Now my husband challanged both above point 1 & 2.

During mediation initially they said 15 lakhs and when I agreeed at 15 lakhs later they reduced to 11 lakhs.

Now what should I do please suggest, I do not want to stay with him and want divorce.

Please suggest what should I do.

If you wanted "divorce" what made you to oppose the divorce  petition filed by your husband ?

Besides this, your petition u/s 9 of HMA has been granted  you must join your  conjugal rights, why do you insist for "divorce" ? Why don't you enjoy your matrimonial life ?

In case your maintenance has been dismissed are you planning to move an appeal before High Court ? 

The amount of alimony is a question of bargaining power of the parties, no one can help.

What is the opinion and advise of the lawyer engaged by you who is an able, competent and intelligent enough to satisfy you, besides the fact that s/he is an instrumental in sailing you through rough wheather i.e., contesting divorce petition filed by your husband and ensured favourable orders for you?

If y

If you desired separation why would you file for Section 9? , and why to contest divorce case. 

It is better to get mutual/consented divorce and get your alimony as settled. 

 

Since he is initiating the appeals against orders, you may submit conditional acceptance by demanding the onetime payment of 15 lac.

 

If you will show leniency now they will negotiate and try to make you reconcile your alimony amount and you will lose more amounts. Just hold on till your husband believe that you will not accept less any amount and conditions.

If you wanted "divorce" what made you to oppose the divorce  petition filed by your husband ?

  • We got love married in 2011 socially and My husband filled divorce in the year 2014 in family court
  • I filled Section 9 and Maintenance in family court
  • As per Family court verdict on 2025, Divorce and maintenance has been dismissed and section 9 has been granted
  • I requested my husband to take me with him so that we can start new life after family court verdict.
  • But he blacklisted me and insulted again
  • After that he challenged divorce and section 9 verdict in high court now.
  • Now it is clear to me that he don't wanted to stay with me further, that's why he challenged again in high court.
  • during high court mediation initially they agreed to settle at 15 lakh but later they reduced to 11 lakh
  • as a housewife non working woman, I got mentally and physically exhausted. So thinking to get divorce now.
  • please suggest whether my thinking is correct?

     - sir, I still love him and always wanted to stay with him, but if he did not allow me?

 - lower court dismissed my maintenance petition by saying that I am qualified and can maintain myself. Knowing the fact that I am housewife and non working woman. So, not sure whether challenging family court verdict on high court will work for me or not. Please suggest

Now you are held up only with the quantum of settlement amount.

Since the mediation is going on in the high court, you may inform the mediators about it and get the amount settled in the lok adalat and give your consent for divorce, you can then ask him to file a mutual consent divorce and get relieved from him legally

It would be better if both of you may sort out your issue(s) amicably or through some relative/ common friend/ relative and/or local marriage counsellor.

However, law can not support your views.
