Your question is not clear. Yet I am trying to reply as per my understanding of your query.

The court can direct the offender to pay for the asked compensation if the aggrieved person is ready to compromise for the same.If he is not ready to compromise, the offender has no option left but to face the trial.

Out of court settlement won't save you from legal liability.
