Name change in annexure 2 of bmc

How to change name in Annexure 2 in BMC , and which documents should I draft?

The original tenant is now dead

Now the wife and son are legal hair of the disease tenant

Now the wife and son ready to transfer the set tenancy in respect of brother of husband

So now which documents should I prepare to transfer and change name Annexure 2

Quick Summary
This discussion addresses the process of changing a name in Annexure 2 of a BMC property when the original tenant has passed away. It clarifies that the deceased tenant's legal heirs, such as the wife and son, must first have the rental agreement transferred to their names. If the legal heirs do not wish to inherit the tenancy, they may forfeit it. The content suggests that the legal heirs will need to execute a fresh rent agreement with the landlord if they intend to continue the tenancy, and advises consulting a local lawyer for guidance.

Before the name change process is initiated, the rental agreement is to be transferred from the original tenant to his legal heirs, if his legal heirs are not interested to get the property transferred to their names, then the tenancy cannot be transferred to any other person as per their whims.

The legal heirs have the right to acquire the tenancy on behalf of the original tenant who is reported to have died.

If the legal heirs do not transfer the rental agtreement to their name then they forfeit the tenancy in the property.

You may consult a local lawyer and proceed with the proposed settlement by an amicable manner.

Since the tenant is stated to have died, his LRs will have to execute fresh rent agreement with landlord, if both parties are willing and agree to continue tenancy.
