Mutual Divorce

The time taken to obtain an order and decree in a mutual consent divorce can vary. While a six-month cooling-off period is generally prescribed, the Supreme Court has clarified that this period is directory, not mandatory. In specific circumstances, such as when spouses have lived separately for over a year and a half, have settled all differences amicably, and reconciliation is impossible, courts may waive this cooling-off period to prevent further distress.
