Mutation issue

I and co-owner were recently conveyed a property with undivided share, joint ownership. Local governing body has a seperate mutation process.  After property was conveyed to our name, coowner is purposefully avoiding mutation process as it involves a hefty fee payment as per local body rules.

This is inconveniencing me a lot and preventing me from applying for other procedures legally.

Is there anything i can do about this other than going for a partitio suit?

You can directly approach the authorities concerned for the desired relief, if you don't get proper reply then you can approach court for remedy.

The mutation for transfer  of title of a property has to be made by concerned authorities  without payment of any fees, which might be  levied in your case / state. 

It would be better to consult a local prudent lawyer with relevant records for professional advise.

You did not mention about type of property stated to have been purchased for  which you are seeking to get the sale deed mutation in your name(s).

Mutation of change of ownership /title is to be endorsed/ sanctioned by Revenue Authority (generally Tehsildar) in Jamabandi for agriculture land on the basis of sale deed, without any charges. In case the property is other than agriculture it has to sanctioned by concerned authority

Respected sirs,

This is industrial land and we have to apply for a process called sub divsion and mutation. Subdivision process comes into picture because co-owner and i were conveyed a smaller portion of larger extent of land originally sold to partnership firm where we were partners and now ex-partners by industrial body. Subdivision charges are being levied for the entire share of land which is prohibitively expensive. I am intending to approach and find out if the charges can be levied on the smaller extent alone conveyed to us by partnership firm.

Meanwhile, there has been a landmark GO issued valid only for 6 months where land with us can be converted to multi use. This application again required subdivision/mutation to be completed.

Co-owner is being highly uncooperative.  Carrying forward some old one sided grudge that i too dont understand and want to complete above procedures for mutual benefit. She is making me beg and beg and lose at every stage.

I cannot partition further because that will attract one more iteration of sub division charges and cost will escalate tremendously.

If you have exhausted the remedies that were available from all the sources without any relief then you may have to escalate the matter through legal sources for relief and remedy.

Sir, all the fees to be paid for subdivision etc are linked to govt rate. If she's not paying now and delaying this, can I ask her to pay for the loss she is causing me?  Since im willing to pay my costs and freeze the expenses but she's evading. If today's cost of one rupee becomes three rupees, can I ask her to pay the two rupees of my liability too?
