Moral Turpitude

Respect Learned Counsels

Does the offence of obtaining scholarship from Government to fund Graduation Course on the basis of a Genuine Income certificate obtained by Suppressing true Income , will be a considered a Crime of Moral Turpitude ?

Will 467 IPC attract in this Case ?

Can police file closure report too if the scholarship is returned back & Income Certificate is being cancelled ?

Quick Summary
This discussion explores whether obtaining a government scholarship using a fraudulent income certificate constitutes a crime of moral turpitude. It questions if Section 467 of the Indian Penal Code (IPC) would apply and discusses the possibility of a police closure report, especially if the scholarship is repaid and the certificate cancelled. The advice given is that the law will take its course and predictions cannot be made without knowing the specific charges and evidence.

If at all there is a criminal complaint against this fraudulent act, then the law will take its own course of action as per procedures of law.

One has to wait and see what all charges have been framed for  this offence which may include any other offence too or not, depending on the situation.

Hence no prediction   can be mde to opine to your imaginary questions.

Whether FIR u/s 467 IPC has already been registered against such beneficiary of scholarship ? If so, it attracts moral turpitude and police will not file closure report even after refund of amount received fraudulantly.

If the certificate is Genuine & recieved after the report of Revenue inspector & lekhpal & Issued by tehsildar , but contains incorrect information. then will 467 attract ?

How do you say that the certificate issued by the Revenue inspector and the lekhpal can be incorrect, what is the proof in your possession?
