Money recovery case

Dear All,

I have booked an under construction flat in Delhi.  When construction got delayed the builder and me mutually signed a "SETTLEMENT DEED" with a clause that "if builder again fails to complete construction work till 1 Feb 2023, than builder will pay Rs 15000 per month as compensation to buyer till the completion of work."

 

Now construction is still pending and builder is not paying the compensation amount.

 

Please suggest legal remedy.

You can issue a legal notice to the builder to honor the agreement and failing to do so, he will be dragged to court of law for recovery.

After that you may file a money recovery suit till the date of filing this suit and seek direction to the builder to pay the same regularly after that every month.

You should have moved / filed a consumer complaint before jurisdictional Consumer Disputes Redressal Commission through a local prudent lawyer.
