Dear Querist,

 

Maternity benefit is available under Maternity Benefit Act, 1961 in India that is applicable to all the establishments with 10 or more employees working under it. 

 

Maternity benefits are also available under the Employees’ State Insurance Act, 1948. The maternity act talks about 12 weeks leave out of which one can claim 6 weeks before delivery or one can ask the employer regarding the extensions and company’s policy related to maternity benefits, as it is important for every employer  to provide the information in writing and electronically about their maternity benefits which are available under the Maternity Benefit Act upon their joining the workforce.
