dear sir, in drt,
bank has filed a case.
there are lot of grivence agaist bank. and counter claim will be filed.
now in banks application in drt (oa) there are lot of things to be clarified. like we have objected that they have not followed procedure to file oa. same is pending in before po.
my question is what is limitation period in which i have to file counterclaim? counterclaim will be on over charging of intrest and not followed terms of agreement.my loss is continueous till case will be decided.
i am advised two opinion, (1. ) 3 yrs after cause of action. (2.)loss is continuous , so i can file after i file written statement in drt......in drt court fees is 1.5 lac. and in civil 3 lac.
pls advise.
