Limitation 12 or 3 years

  • Plot purchased by registered sale deed in 2009.

  • Fraud discovered in 2021through a survey report showing that the land shown to you was different from what was in the registered sale deed.

  • You filed a new civil suit seeking:

    • Declaration of title(ownership / invalidity of wrong descripttion),

    • Rectification of boundaries (correction of sale deed / boundaries), and

    • recovery of Possession (since the defendant / vendor is in possession).

 so please tell me is limitation  12 years or 3 years from discovery of fraud . thank you

The period of  limitation  is three years from the know of the alleged fraud? However, the moot question is, does the facts posted suggest a fraud?

What do you mean by "that the land shown to you was different from what was in the registered sale deed."?

The limitation will be 3 years from the date of knowledge of this fraudulent sale of property.

If case is based on fraud then the limitation will be three years from the date of knowledge of fraudulent act.

Hi sir thank you for your reply. The limitation for recovery of pocession is 12 years which is main relief. Declaration of title and rectification of boundaries is 3 years which is auxiliary relief.  I just know read a judgement so it is 12 years

 

I am not cancellation of sale deed. 

it is for recovery of pocession.
