There is no difference in it. The party, through its lawyer give notice and the party in person gives notice is the same.

You can send the legal notice yourself without the assistance of an advocate provided you know the legalities involved in it.

A 1. Yes, an individual can issue legal notice if s/he is aware about the law applicable on the subject.

A 2. Such notice is valid and legal.

A 3. It is different only to the extent that name and locus standi of person issuing the notice.

It is better to consult a local prudent lawyer for proper analyses of facts / documents, professional advise and necessary proceeding to protect your interest.

Yes, the Secretary or the authorised office bearer can issue such a letter highlighting the by-law as well the law involved and consequential legal action if the individual does not comply.

A client (or any individual/entity) can issue a legal notice themselves in India. While it is a common practice to hire a lawyer for this purpose, there is no statutory law that requires a legal notice to be sent exclusively by a legal practitioner. A legal notice issued by a person themselves has the same legal validity as one sent by a lawyer, provided it contains all the necessary facts, specifies the breach of contract/wrongdoing, and gives a reasonable timeframe for compliance. It serves as documentary evidence in court, proving that the sender made a reasonable attempt to resolve the issue before pursuing litigation.

Although permitted, sending a notice without a lawyer can be dangerous because you may accidentally admit to facts that weaken your case in court later. You might miss legal details (like limitation periods) required by specific laws. Vague language in a self-drafted notice can be exploited by the other party. Thus, while legally valid, a self-issued notice should only be used for straightforward, low-stakes issues. For complex matters, it is safer to have a lawyer draft it.
