legal heirs of un- married female with mother as the nominee.

my unmarried sister expired and she had nominated my mother as nominee for the savings bank account.my mother has also expired.Since my expired mother was class 1 legal heir ,whether her children are the legal heirs as per Hindu law of Succession, please let us know please.

Quick Summary
This discussion concerns the inheritance of assets for an unmarried woman whose nominated beneficiary, her mother, has also passed away. Under Hindu Succession Law, if the mother was a Class 1 legal heir, her children would typically inherit from her estate. In this specific case, the father is identified as the primary legal heir to claim the deceased unmarried daughter's assets. If the father is also deceased, then the siblings of the unmarried woman would be considered legal heirs.

All LRs of your unmarried sister as well as mother shall have share in the intestate properties left by them.

  • In the case of an unmarried deceased woman, her property will be distributed among her parents, and her father and mother can apply for a legal heir in this regard.
  • Since the mother is also dead, the father can claim and succeed to her both movable and immovable assets as her legal heir.
