Sorry, I couldn't find the specific information about your query.

Since your mother passed away without a will, the property inheritance would typically follow the legal succession laws applicable to her. If the property belonged to your father, he is likely the legal heir.

If your father has passed away, the property would devolve upon his legal heirs, which may include you and other family members.

You may want to try searching online for "legal heir certificate process" or "property inheritance laws" applicable to your location for more guidance.

Since the property is on name of your father's elder brother who died intestate and his class 1 heirs ( wife & childre ) are also no more so his property rights will devolve to his class 2 heirs ( brother's son/sister's son ) and being his class 2 heir you can claim share in his property alongwith other class 2 heirs.

Can you redraft facts vis-a-vis query as it is vague.

T. Kalaiselvan, Advocate (Advocate)     17 December 2025

Your father's elder brother's class I legal heirs shall be the successors in interest, in the absence of class I legal heirs, then the class ii legal heirs shall be entitled to acquire the intestate property.

Your elder mother means, is she paternal or maternal? Vague query.

P. Venu (Advocate)     17 December 2025

The query is short of material facts.

What do you mean by "elder mother"?

It appears the property belonged to her late husband and that they had no children.

What is the personal law applicable i.e. wheter Christian, Hindu or Muslim?

How the late husband had acquired the property - by inheritance or by purachse or other means?

Please post the complete facts.

Still relevant facts are missing from the post.

It is better to consult a local prudent lawyer for proper appreciation of facts/ documents, professional advise and necessary proceeding

If your maternal aunt was not survived by her own children then the property inherited by her from her deceased husband shall devolve on the legal heirs of her deceased husband.

The author is silent whereas experts are trying to convince themselves by assumptions and presumptions, which may be incorrect/ irrelevant.
