What legal action can be against an IAS who gives decision against public interest and against law?


Quick Summary
If an IAS officer makes a decision that goes against public interest or the law, there are specific legal actions you can take. For administrative or professional misconduct, complaints should be filed with the relevant Departmental Personnel. Criminal misconduct requires reporting an FIR to the police. Allegations of corruption can be reported to the State Director of Vigilance. If a competent authority has acted unlawfully and outside their jurisdiction, you may need to pursue legal action in court against both the builder and the department involved.

  • Complaints against IAS officers are to be filed with the Departmental personnel of the State or Centre , as the case may be if the complaint pertains to administrative or professional lapses.
  • If the complaint pertains to criminal misconduct, the case should be reported as an FIR at the appropriate Police Station.
  • If the complaint pertains to allegations of corruption, and merely conjectures, the report may be sent to the State Director of Vigilance.

Residents of a colony submitted complaint against the builder but the competent authority acted against the law, gave unlawful decision against public, going out of their jurisdiction.
