Legal action against bank managers

Hi,

Can a tenant take a legal action against the current bank manager and x bank manager coz the fraud borrower is absconding.

1. The x bank manager has sanction huge loan to the borrower on stocks which doesnot exist and again the (Nil) stocks were kept on rented shops which now no longer exist.

2.  Before absconding, the borrower has given us false NOC of bank ( with the stamp and signature of manager) the same when we informed the manager he was laughing and didnt take any legal action against the borrower. The borrower even placed ad in two local newspaper.

3. The corrupt bank manager has combined all the loans amounts  which were given on stocks and now asking us to vacate the flat.

Can i take legal action against the bank managers, plz give ur valuable suggestion.

In this case simple principle of torts apply.

1. There was a duty to take care.

2. The duty has been breached.

3. Harm has been caused due to that.

In this case you can not file a complaint against bank officer. You can file a complaint againt the landlord. Since you are a tenant and have no legal right in the property against the bank, you cannot file a complaint.
