Leal notice for partially paid salary.

Hi -

We had a division of our company that we had to close. All employees were fired on 7 days notice and that's what is mentioned in the Employment terms too that they will be given a 7 days notice period.

We asked some of them to stay for another week (even though half of the staff was gone), so that they can wrap up the work they had to do.... and some chose not to.

So, we kind of with help the salary for of about 7 days for few of them and hope we would release them later.

Now, one of them sent over a legal notice from a lawyer for that 7 days salary and saying that we have to pay 3 months salary or legal action will be taken.

What rights do i have as a employeer?

Aparently you have not offered any alternate employment.The lay off/retrenchment compensation is well explained in ID Act. In some of the states compensation @ 15days salary/year of service is also inserted. You can close a div. As per due process of law with information to lawful authorities and have to subscribe to law of the land or can be penalized. Approach your lawyer if you chose to contest.
