Land sale satakhat

Respect sir,

We have sale our land in 2017 with satakhat and in this satakhy we have mentioned that our payment system would be in three part fist advance second after partition of block of our land and third when documents registration in registrar.... in 2018 we clear our block partition...but they not given any payment and write down satakhat and mention money that we recieved only half compared mentioned in satakhat....after they discontinue contact with us and now tomorrow they give us legal notice court notice... that we are cheating them .... a also satakht is done their lawyer on 100 rupee stamp... please guide me what to do... sir

satakhat is document that showed buyer and seller details with sale agreement with payment condition

Primarily there was an unregistered sale agreement with certain conditions for execution of sale deed at a later date if the buyer makes the periodical payments as per the conditions of the agreement.

The sale agreement is valid only for three years from the date of agreement or three years from the date of the latest payment.

However if the buyer without making the further payment neither had excpressed his willinginess and readiness to purchase the property nor had indicated about the confirmation of balance amount for registraion, the legal notice will not hold good even if he approaches court subsequently with a suit for specific performance of contract.

First you issue a reply notice denying the allegations and then you can challenge the case in court.

The court may grant the alternative prayer to return his amount if it is proved that the sale agreement was properly excuted

respect sir.... they filed SPCS SUIT Against us..... whenever this document is formed there is no handwritten statement on it .. but they gave a xerox of satakhat where the  hand written terms were written...  can it valid... there handwritten terms is after satakhat done... there is no sign of any of that ... please guide...hand written statement says that is they unable to pay the payment in during or after given time .. the issue will be solved by meeting two party and make out solution.... is it valid on typed document handwritten statement....
