land purchased, payment through check, did not register agreement

I purchased a property and we paid the amount through cheque and agreement was also done, agreement was valid till 3 years the other party pushed on the time did not register the property in my name, he is dead now his children have sold the property to another person. will I lose the case though I paid the amount to the seller. I have the position of the property.
