Land acquisition act 1894

Hello All,

I need some advice here.

Scenario - A land owner by mistakenly assumed to be acquired (since land adjacent to his land was notified)  for development authority in 1979 (Preliminary Notification) - 1985 (Final Notification), however he recently (2021) on detailed verification of the Notifications found out that his name was not in the Gazette Notification list. He is currently in possession of the same land, he has now approached the High Court to consider this pleadings and restore back his land. Will he succeed? Does this attract Limitation Act?

Also in addition to that, I see the bare act it just mentions about what are the rules to be followed if the land is notified for acquisition. Is there any section where it is mentioned what if the land owners name is not there in the Gazette notification?

Please suggest if there is any case laws I can read about it

Admittedly, you contine to be in posseession. If so what your problem?
