See actully there is a minute difference between judicial seperation and divorce. u/s 10 in hma  define about judicial seperation which says seperation of spouse for  1 year. in this 1 year there could not establish aany physical relation between them.

My Question :

1. What is the benefit of legal seperation over divorce  ?

2. is there any legal right of spouce on property / income after legal seperation ?

3. what if wife not ready for divorce , can husband go for legal seperation ?

4. is Legal seperation is as lenghty and tedious process as getting divorce ?

5. under what section i ( i m husband) can calim for this ?

I Have heard that in judicial separation the husband or wife if they are not permissible to have intercourse (s*x) as per the law but in divorce they can have intercourse.  If any case laws on it  whether they can have a intercourse or not in judicial separation & in divorce decree ?

God Bless.
