PRAVEEN KUMAR SINGH   18 May 2020

JOINT REGISTERED PROPERTY

We are 3 brother and have some joint property. One of my brother is cunning and is betraying us, can we restrict him from entering the property and pay the actual cost with interest.

Quick Summary
If you and your brothers jointly own property and one is acting unfairly, you may need to take legal action. The recommended course of action is to file a partition suit with the help of a senior local advocate. While paying off the difficult brother is an option if he agrees, a partition suit is the formal legal route to resolve disputes over joint ownership and usage.

You shall file partition case by consulting a local senior advocate.

No, you cannot pay him off. The option is to file a partition suit.

All three of you may compromise ,pay his share and get a registered sale deed qua his share, if he agrees.

Otherwise, file a suit for partition through a local prudent lawyer as advised by experts Mr KAVK Satyananrayana and Mr. P Venu, I concur.
