Is the pensioner ( 40 k/month) has to pay rent to son if he is staying in son's house

Father retired in 2000 and sold his own flat. He started staying in the house registered on son's name. The son is staying in another city. Now in the year of 2022, father shifted to another location. He is demanding maintence from the son although his pension is 40K and not dependent. He is humiliated son on the phone many times and threatened to kill him. In this situation, son can ask for rent from 2000 to 2022 as he stayed in his house and son only paid all the loan EMIs and society maintenance charges etc.

Father can claim maintenance from son provided he is not having sufficient source of income to sustain his expenses.  As he is already drawing pension amount of Rs. 40,000 per month, his claim may not be entertained by court even in case he is approaching the senior citizens wflfare tribunal for this reason

Sir,

Thank you for reply. He stayed in son's house since year of 2000 till 2022 without any rent paid to him. Now when he shifted to another location, he is harrassing son to pay him money. Here the question is can son ask for the rent that is not paid to him from 2000-2022 and parents stayed free of cost and enjoyed all the facilities of the house.

The son cannot claim rent from his father for staying in his house.

Likewise if father is not staying in son's house then he cannot claim rent from son if he has voluntarily left the son's house
