SEVEN QUESTIONS FOR DEFAULTERS

 

(1)  Is ignorance of duties by public servants “CRIME AGAINST NATION (RASHTRADROH) ?”

 

(2)  Is this “BREECH OF CONTRACT” ?

 

(3)  Can they be charge-sheeted by Police on a complaint by a citizen ?

 

(4)  Can the Court of Law move trial for this ?

 

(5)  If the charge of ignorance of duties proved; what will be punishment ?

 

(6)  Can the unjustified emoluments received by them or paid to them be recovered ? With interest ?

 

(7)  Can their monitoring supervisor be take up equally ?

There is no remedy other than writ of Quo warranto against public servant.

Even there is no limit in deviation from the standard order, since they enjoy discretionary power. Although Police too is of same feather. One can not complain about a thief to a thief. Prior permission and saction is reqd to charge them in any case.

For breach of official duty the superior officer can take disciplinary action against the erring officer for dereliction of duties, and I don’t think writ of quo warranto would lie, as the word Quo-Warranto literally means "by what warrants?" It is a writ issued with a view to restraining a person from acting in a public office to which he is not entitled. The Writ of quo-warranto is used to prevent illegal assumption of any public office or usurpation of any public office by anybody. For example, a person of 62 years has been appointed to fill a public office whereas the retirement age is 60 years. Now, the appropriate High Court has a right to issue a Writ of quo-warranto against the person and declare the office vacant.

Assumi sir, Higher Officers collects monthly levi from subordinate Officer. They all part of chain in collection which goes upto minister and into party fund. So how they will take any action. All posts come with price tag. Law Court and other ethics are farce nowdays. Bribe/Criminal activities prevails over evrything/every law

Public servants of Secretariat of Maharashtra.

 

There are Electronic Card Punching Machine (Unit) are provided/affixed on walls in ground floor of the Building.  Public servants who punched their card don’t mean that they reached to their seats.  They reaches after 15-30 minutes on their seats.  They only keep their Bags to show that they arrived.  Immediately they goes under pretext for Tea or to toilet and they waste about 30-45 minutes. They physically be seated near about at 11 o'clock. 

 

The Lunch time is from 01.00 to 01:30.  but they gets up and go out at 12:30 and comes back near 02:30.

 

At 3:30 they go for Tea and waste about 30-60 minutes.

 

Working time is up to 05:30 PM but they stop working at 05:00 and start packing bags.

 

Another side, the Citizens who comes for chasing their matters whichever is pending at Secretariat, they are being kept in "Q" under sun rays where even no seating arrangements done.  Poor People from long distance rural areas of Vidarbha are being badly suffered.  The Citizens are only allowed to enter after 02:00 o'clock.  It is the time to open entry at check post at main gate.  When people reaches inside they found that the public servants are gone for Tea or toilet.  When public servants return at their seats there is only one hour remains for working of office. 

 

The Citizens of Maharashtra are given a burden of Rs. TWO LACS CRORES.   People have no proper electricity.  No water.  Formers have no water for their Forms and committing suicide....  WHAT TO SAY ?????

PLEASE AUGGEST AS TO WHAT THE LEGAL ACTION CAN BE TAKEN AGAINST THE DEFAULTER PUBLIC SERVANTS AND WHETHER THE OVER PAID SALARY CAN BE RECOVERED FOR THEIR LACK PRESENCE

NO BECAUSE THAT  LEGAL PROVISION NOT AVAILABLE IN INDIA.

AGAINST THE BUREOCRATS, ONE MAY GO TO COURT. FOR JUNIORS, MAY COMPLAIN BEFORE THE HIGHER OFFICIALS.
